We seek to provide access to unpublished decisions from courts and tribunals. All of the decisions provided by FORCIN are published in accordance with the NSW Copyright in Judicial Decisions instrument published in Gazette No. 23 of 3 March 1995. What?
You may be surprised to know that the not every written decision of a NSW court and tribunal is published on the NSW Caselaw. Setting aside those whose publication is restricted by an order, there are also some that simply never make it to the Caselaw. Now, also those decisions that were not lucky enough to be selected for publication on the NSW Caselaw will find their cozy place on the net.
Who?
FORCIN wants to change this. We provide access to those previously unpublished decisions for courts and tribunals whose publication is lawful.
When?
Now. The time is now.
Why?
FORCIN recognises that judgments are helpful to not only those affected by the decision but also to the general public. By reading the past decisions you can learn from the mistakes of others. You can also assess if you want to bring your matter to a given court. Does that court, in you opinion, provide the minimum of procedural fairness? Does it provide it to everybody, regardless of their connections and wealth?
Access to limited judgments can lead to erroneous decisions as to whether or not commence the litigation. Do you think it would affect you if the only decisions available were those decisions the courts are proud of? What if the government withheld all the decisions made in breach of natural justice? Do you think this could make you mislead you as to how well the system of justice were working?
At FORCIN we think that it is the best to see the whole picture. So that you know and see a little bit more, we are initiating the Unpublished Decisions Series.
